Welcome to Tinyloops. These Terms of Service ("Terms") govern your access to and use of the Tinyloops website (the "Site") and your purchase of products from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

"Tinyloops," "we," "us," and "our" refer to the operator of this Site. "You" refers to the person accessing the Site or placing an order.

1. Eligibility

The Site and our products are intended for customers located in the United States who are at least 18 years old (or the age of majority in your state). By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.

We do not currently sell or ship outside the United States.

2. Products and Personalization

Tinyloops offers hand-knit baby sweaters that can be personalized with an embroidered name or short text ("Personalization"). Because each item is made to order:

• All sales are final once an order is confirmed, except in cases of seller error (see Section 6 and our Returns & Exchanges policy).
• You are responsible for the accuracy of any Personalization details you submit, including spelling, capitalization, and characters. We will produce your item exactly as entered.
• We reserve the right to refuse or cancel any Personalization request that we determine, in our sole discretion, to be offensive, profane, infringing, harassing, or otherwise inappropriate. If we cancel an order for this reason, we will refund the purchase price.
• Product photos are representative. Because each piece is hand-knit, slight variations in yarn, stitching, and finishing are normal and are part of the handmade character of the item.

3. Pricing and Payment

All prices are listed in U.S. dollars and do not include applicable taxes or shipping charges, which will be calculated at checkout. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.

Payment is due at the time of order. By submitting payment information, you represent that you are authorized to use the payment method provided.

4. Order Acceptance and Confirmation

When you receive an order confirmation email from us, your order has been accepted and production has begun. Because each item is hand-knit and personalized to order, orders cannot be canceled or modified once the confirmation email has been sent.

If you notice an error in your order (such as a misspelled name or wrong size), please contact us immediately at hello@tinyloops.shop. We will do our best to accommodate changes if production has not yet started, but we cannot guarantee changes after the confirmation email is issued.

We reserve the right to decline or cancel an order before sending a confirmation email, including in cases of suspected fraud, pricing errors, or violations of these Terms. If we cancel an order before confirmation, we will refund any amounts charged.

5. Shipping

Shipping terms, timelines, and costs are described in our Shipping Policy, which is incorporated into these Terms by reference. Risk of loss and title to products pass to you upon delivery to the carrier.

6. Returns and Exchanges

Because every Tinyloops item is made to order and personalized, we do not accept returns or exchanges except in cases of seller error (such as a defect in workmanship or an order shipped incorrectly through our fault). Full details are in our Returns & Exchanges policy, which is incorporated into these Terms by reference.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, and the "Tinyloops" name and branding, is owned by us or our licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any of our content without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

8. User-Submitted Content

When you submit Personalization text, photos, or other content to us, you represent that:

• You own or have the necessary rights to the content;
• The content does not infringe any third party's rights, including intellectual property, privacy, or publicity rights;
• The content is not unlawful, harmful, defamatory, or otherwise objectionable.

You grant us a non-exclusive, royalty-free license to use the content for the purpose of producing and delivering your order, and in some cases marketing and advertising responsibly.

9. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law;
• Attempt to gain unauthorized access to the Site, our systems, or other users' accounts;
• Interfere with or disrupt the Site or its servers;
• Use any automated means (bots, scrapers, etc.) to access the Site without our written permission;
• Submit false, misleading, or fraudulent information;
• Resell our products without our prior written authorization.

10. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their own terms.

11. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any product description, image, or other Site content is complete, accurate, current, or error-free.

Safety notice: Tinyloops products are decorative knitwear intended for infants and young children. As with all baby clothing, garments should be inspected before use, fitted appropriately, and never used as a substitute for safe sleep practices. Loose threads, buttons, or embellishments should be checked regularly. Adult supervision is required at all times when the garment is worn.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TINYLOOPS, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Tinyloops, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party right.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution

Before filing any formal claim, you agree to first contact us at hello@tinyloops.shop and attempt to resolve the dispute informally. We will work in good faith to resolve any concern within 30 days.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, along with our Shipping Policy, Returns & Exchanges policy, and Privacy Policy, constitute the entire agreement between you and Tinyloops regarding your use of the Site and supersede any prior agreements.
